Welcome to Birdly. These Terms of Service ("Terms") govern your use of the Birdly mobile application and related services ("App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy.
If you do not agree to these Terms, do not use the App.
You must be at least 13 years old (or the age of digital consent in your jurisdiction) to use Birdly. If you are under 18, you confirm that you have permission from a parent or guardian.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to these Terms and applicable app store rules.
You may not copy, modify, reverse engineer, distribute, sell, or create derivative works from the App or its content except as permitted by law.
Birdly offers a free tier and optional Birdly Premium subscriptions (monthly or lifetime). Premium features include unlimited identifications, offline access, and full encyclopedia access.

In addition, the machine-learning models that power recognition in Birdly are licensed on terms that prohibit certain uses. These prohibitions are passed on to you, and they apply to the App, to its recognition results, and to any data derived from them. You must not use any of them:
Birdly is provided for nature observation, research, and general education. If you cannot comply with the restrictions above, you may not use the App.
Birdly provides bird sound and image identification powered by AI. Identification results are probabilistic and may not always be accurate — wildlife conditions, audio quality, and species overlap can affect results.
Birdly is an educational and recreational tool. Do not use it as the sole basis for scientific research, conservation decisions, or any activity that requires certified species identification.
You retain ownership of recordings, notes, and photos you create in Birdly. To the extent necessary to provide App functionality (for example, processing a recording for identification), you grant Birdly a non-exclusive, worldwide, royalty-free license to use your content within the App for that purpose. This content is processed locally on your device and not uploaded to our servers.
Your use of Birdly is also governed by our Privacy Policy.
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We do not guarantee that bird identification will be accurate in all circumstances, or that the App will be uninterrupted or error-free. Identification accuracy depends on audio quality, species, and environmental conditions.
The machine-learning models named in section 11 are likewise provided by their authors "as is", without warranty of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose, or non-infringement. An identification is a probability produced by a statistical model, not a determination.
By using the App and making in-app purchases, you consent to the sharing of data regarding your usage of purchased content with the applicable app store, as required to process refund requests, in accordance with platform policies.
The App and all related trademarks, logos, and content are the property of Birdly and its licensors (unless otherwise stated). You may not copy or use them without permission.
Sound recognition is powered by BirdNET. The BirdNET+ V3.0-preview model was developed by the K. Lisa Yang Center for Conservation Bioacoustics (Cornell University), Chemnitz University of Technology and Museum für Naturkunde Berlin, and is used unmodified under the Creative Commons Attribution-ShareAlike 4.0 International licence. Photo recognition uses AIY Birds V1 by Google under the Apache License 2.0. Species data and images are provided by the iNaturalist community under the licences attached to individual observations. All other App code and assets remain proprietary.
To the fullest extent permitted by law, Birdly and its creators will not be liable for any indirect, incidental, special, consequential, or punitive damages or any loss of data, profits, or goodwill arising from your use of the App.
To the extent permitted by law, Birdly's total liability for any claim related to the App shall not exceed the amount you paid for Birdly Premium in the twelve months preceding the claim, or USD $10 if you use the free tier.
You may stop using the App at any time by uninstalling it. We may suspend or terminate access if you violate these Terms.
We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use after changes constitutes acceptance.
These Terms are governed by the laws applicable to you, where you reside, subject to mandatory consumer protections in your jurisdiction.
